雪梨跨年的訂房被取消了>"<

本來在7/1號的時候在hostelwolrd訂了Sydney Central Backpackers五天的房間
結果今天竟然收到一封『book error』的信
說是系統錯誤,他們其實已經沒有床位了,要取消我們的訂房= =
我能不能要求賠償呀>"<現在都八月多了,我要去那裡找雪梨跨年的住宿呀>"<嗚嗚嗚~~

我看好像蠻多人訂這間的~你們也都被莫明其妙的取消了嗎?

原文信件如下
We recently received a booking request from you for the Christmas / New Year period at the end of this year. The booking request was made through the Hostel World website.

We are emailing to apologise and inform you that our hostel was already fully booked for the holiday period. So, as much as we would love to have you stay with us, we do not have any beds available.

Our hostel is leased over the Christmas holiday period to another hostel group and they had already filled all of our beds. Unfortunately they had forgotten to inform us, so Hostel World thought we still had beds available, which we did not.

Please note that a booking fee was charged to your credit card when you made the online booking request. We have now refunded that amount t the credit card you used to make the booking.

Once again please accept our apologies for not being able to accept your booking and we are sorry for any inconvenience caused.

去澳洲類似台灣消費者基金會的ACCC求援吧!

上面有清楚記載如何申訴,
不過成效會有多大就很難說!

BACKPACKER的作法我比較不懂,
但如果今天是發生在五星級飯店的話,
可沒這麼容易解決!
尤其當訂金都付了,就是雙方契約產生並同意的開始,
我覺的寫信給上述兩家經手單位都沒用,
因為很可能還是會被推託,
想想看他們都趕把你大辣辣趕出來了,說沒房間租給你,
都這時候了,誰不知道那個時段整個雪梨有多難找住宿?

我自己很幸運,
因為是跟朋友一起租一整個suite,
所以才得以還在前幾天訂到房間,
如果你只是要兩個人,我查過了機會微乎其微,
試試看有沒有辦法和其他朋友一起訂飯店的套房吧!

時間上要花很久,這點除了接洽過的人不然沒人可以說的準。

這點我就不太同意了!
如果這樣不構成任何問題,
那是不是今天任何一家飯店或backpackers都可以任意取消訂房,
隨便邊派個理由,管住客去死?反正錢退了就好!
這樣似乎說不太過去!!
成效會有多大,沒試過申訴誰也不知道,
我想房間還是繼續找,有機會就快訂,
但是申訴我建議還是去做,畢竟還有3-4個月的時間,
錢不是重點,但如果因此他們必須要撥出一個客房給你好履行義務,
那不是很好嗎?(就算到時候已經不需要...)
有時候勞心勞力單純為自己討一個公道也爽!

妳的心情我可以了解。一個多月前,我也是先看上這一家評價不錯,且在市中心的飯店,重點是我也是第一次利用全英文介面的網站訂房,一開始也是ok,也確認過信用卡沒問題,一切看似順利的情形下,隔天,我就收到飯店的e-mail,通知我說沒房間,讓我傻掉。

介紹妳一個不錯的組織,YHA澳大利亞(http://www.yha.com.au/zh/index.cfm?),就是國際青年旅舍,便宜很多,妳可以先上"中華民國青年之家協會"申請國際青年旅舍卡(650元),約兩個星期就可收到,利用這張卡到澳洲的青年旅舍住宿,可享九折優惠,try it!

ACCC 對 lookgrl 不是很有用的. 它能做的事情 只有

# Give you information about your consumer rights and obligations.
# Suggest possible courses of action you might take.
# Suggest the right agency to complain to if we cannot help you.
# Provide a range of consumer information materials so you can learn more about your consumer rights.
# Investigate business conduct occurring nationally or across state borders.

跟 Office of Fair Trading of NSW 差不多. 除非 Sydney Central Backpackers (SCB) 認錯要幫妳解決, 其實沒有辦法的.

妳完全沒辦法跟 Hostelworld 要求賠償, 因為在它的 Booking Condition 裡寫著
Cancellations

Hostelworld.com does not accept responsibility for cancellations by you or by the travel services provider regardless of the circumstances in which the cancellation is made.

Hostelworld.com shall not accept any liability for losses, additional expenses or any claim whatsoever due to changes in accommodation or other travel services, sickness, weather, strikes or any other cause. All such losses, additional expenses or claims will be borne by you unless otherwise agreed between you and the service provider.

In contract, 如果要告 SCB, 或是要寫信假裝告它的話, 妳要知道妳要的賠償是什麼.

1. Compensation
如果要 SCB 付錢讓妳去住其他的地方的話, 應該是不太可能, 而且不知道要要多少錢. 因為SCB 有在在離住宿日期三, 四個月跟 lookgrl 講. lookgrl 應該有足夠得時間去找其他住宿地點.

2. Performance
比較可能的方法是寫封正式的信給 SCB 要求履行合約.

To whom it may concern,

I, [full name] or [full address] are writing in regards of a booking on [date arriving] to [date departing].

I have been informed that the booking has been cancelled due to the negligence of the Sydney Central Backpackers (SCB) and the management group to whom SCB leased to during the booking period.

I am seeking damages for [要它賠的金額] for breach of the contract. Alternatively, I seek the performance of the contract.

It must be stressed that upon the payment of the deposit, consideration was provided in exchange of a "guaranteed" bed.

The damages I seek are for alternative accommodation arrangement during the busy Christmas period.

大概這樣不過妳改一下. 不過很多事情有時候就是不好運, 沒有辦法要求誰要賠給誰. 我建議妳寄信給 SBC 但還是找其他地方住.

我剛還真的打電話去給ACCC向他們詢問這樣的情形要如何處理。

我假裝是當事人,
他們建議我打電話給Office of Fair Trading of Queensland(因為我在QLD),
基本上他們說雖然是對方的錯,
但他們已經願意全數退款給你,
所以沒有什麼可以要求的了。

但如果你因此取消行程,
要cancel機票,有cancellation fee之類的charge,
可以嘗試到Office of Fair Trading of xxx去申訴,
但至於他們能幫你做到什麼程度,
得看到時候他們處理和協調的狀況,
有可能你能要求那家旅館賠償你取消機票的費用,
但也有可能什麼都要不回來。

總之你就試試看吧!
坦白說這也不關我的事,
我還打去跟他揮很久,
他講一句話我一直無法忘懷的就是:
他已經承認錯誤並同意全數退款給你,你還要求什麼? 你要他給你一個他不可能給你的房間嗎? 還是你覺得他應該要賠償你更多?

那小姐說要求可以,但要在合理的範圍之內,
到時候如果案子真的成立裡以後,也會是狀況決定是不是應該給你額外的補償。

到底這世界是怎麼了?

被莫名其妙告知房間不給你住了,
要你再去重新找住宿的地方,

我反問那位小姐,
今天家人訂了機票準備大老遠來一趟澳洲,
萬一在這中間我訂不到房間,沒地方可住,
家人要cancel機票,
我也必須cancel國內線機票,
誰來賠償這費用?

他回答我:為什麼要cancel機票不去?
我回答:Because i have no where to stay!

他回我:喔,那去申訴吧!
然後就給了我電話...

lookgrl,你真的很可憐,
你就好好祈禱可以找到地方住,
不然你的精神損失也沒人在乎!
三四個月是很久沒錯,
但誰不知道那時候的房子特別難找!?

雖然大家都知道是 Sydney Central Backpackers 的錯, 但是在法律上就是這個樣子的. 基本上只要你沒有"真正"損失什麼是很難贏的. 因為你也不知道要他賠什麼.

不過你想想, 如果妳今天是一家 hostel 的老闆, 如果你跟旅客說沒位子了, 然後他要你付機票錢或是住其他旅館的錢你也應該不會拿出來吧.

如果是很誇張很誇張的情況, 它應該會提供合理的賠償, 不過還是很難.

旅館賠妳機票或是其他住宿費用對它不公平, 不賠對妳不公平. 所以有時候只好自認倒楣, 就只好當做不好運了. 希望妳能找到住宿地方.
孤獨似我
依我自己以前在台灣五星級飯店工作的經驗,
如果over booked,
會把房客移到同等級的其他飯店去,
當然事前會先徵求同意,
如果有價差是會由飯店自行吸收。

我工作的飯店是這樣,
也許因為是五星級,跟backpacker的態度才會有所不同。
所以還真是一分錢一分貨啊!
至少我自己是這樣感覺的!!
