本來在7/1號的時候在hostelwolrd訂了Sydney Central Backpackers五天的房間
結果今天竟然收到一封『book error』的信
說是系統錯誤，他們其實已經沒有床位了，要取消我們的訂房= =
我能不能要求賠償呀>"<現在都八月多了，我要去那裡找雪梨跨年的住宿呀>"<嗚嗚嗚~~
我看好像蠻多人訂這間的~你們也都被莫明其妙的取消了嗎？

BACKPACKER的作法我比較不懂，
但如果今天是發生在五星級飯店的話，
可沒這麼容易解決!
尤其當訂金都付了，就是雙方契約產生並同意的開始，
我覺的寫信給上述兩家經手單位都沒用，
因為很可能還是會被推託，
想想看他們都趕把你大辣辣趕出來了，說沒房間租給你，
都這時候了，誰不知道那個時段整個雪梨有多難找住宿?

因為是跟朋友一起租一整個suite，
所以才得以還在前幾天訂到房間，
如果你只是要兩個人，我查過了機會微乎其微，
試試看有沒有辦法和其他朋友一起訂飯店的套房吧!

ACCC 對 lookgrl 不是很有用的. 它能做的事情 只有

跟 Office of Fair Trading of NSW 差不多. 除非 Sydney Central Backpackers (SCB) 認錯要幫妳解決, 其實沒有辦法的.
妳完全沒辦法跟 Hostelworld 要求賠償, 因為在它的 Booking Condition 裡寫著
Cancellations
Hostelworld.com does not accept responsibility for cancellations by you or by the travel services provider regardless of the circumstances in which the cancellation is made.
Hostelworld.com shall not accept any liability for losses, additional expenses or any claim whatsoever due to changes in accommodation or other travel services, sickness, weather, strikes or any other cause. All such losses, additional expenses or claims will be borne by you unless otherwise agreed between you and the service provider.
In contract, 如果要告 SCB, 或是要寫信假裝告它的話, 妳要知道妳要的賠償是什麼.
1. Compensation
如果要 SCB 付錢讓妳去住其他的地方的話, 應該是不太可能, 而且不知道要要多少錢. 因為SCB 有在在離住宿日期三, 四個月跟 lookgrl 講. lookgrl 應該有足夠得時間去找其他住宿地點.
2. Performance
比較可能的方法是寫封正式的信給 SCB 要求履行合約.

大概這樣不過妳改一下. 不過很多事情有時候就是不好運, 沒有辦法要求誰要賠給誰. 我建議妳寄信給 SBC 但還是找其他地方住.

我剛還真的打電話去給ACCC向他們詢問這樣的情形要如何處理。
我假裝是當事人，
他們建議我打電話給Office of Fair Trading of Queensland(因為我在QLD),
基本上他們說雖然是對方的錯，
但他們已經願意全數退款給你，
所以沒有什麼可以要求的了。
但如果你因此取消行程，
要cancel機票，有cancellation fee之類的charge，
可以嘗試到Office of Fair Trading of xxx去申訴，
但至於他們能幫你做到什麼程度，
得看到時候他們處理和協調的狀況，
有可能你能要求那家旅館賠償你取消機票的費用，
但也有可能什麼都要不回來。
總之你就試試看吧!
